These Terms govern your use of MailFix services, including diagnostics, guided remediation, monitoring, and subscription features. By creating an account or using the service, you agree to these Terms.
1. Scope of Service
- - MailFix provides technical analysis and workflow guidance for email deliverability.
- - Service outputs are recommendations; implementation remains under customer control.
- - Deliverability depends on third-party systems (DNS providers, mailbox providers, sender reputation).
2. Eligibility and Account Use
- - You must have legal authority to manage domains/systems you submit for analysis.
- - You are responsible for account credentials and all activity performed under your account.
- - You must provide accurate billing and profile information.
3. Fair Use and Prohibited Conduct
- - No unauthorized scanning, abuse, reverse engineering, or attempts to disrupt service.
- - No use for unlawful email campaigns, spam operations, or malicious infrastructure testing.
- - We may suspend accounts that violate law, third-party terms, or these Terms.
4. Pricing, Billing, and Subscriptions
- - Subscription and add-on pricing is displayed before checkout and may change prospectively.
- - Recurring subscriptions renew until cancelled according to your selected plan cadence.
- - Taxes, if applicable, may be added according to local legal requirements.
5. Service Levels and Support
- - Target first support response SLA: within 24 business hours.
- - SLA is a target, not a guarantee of uninterrupted or error-free service.
- - Planned maintenance or force majeure events may affect availability.
6. No Guarantee / Disclaimer
- - MailFix does not guarantee 100% fix, 100% inbox placement, or specific revenue outcomes.
- - Recommendations are provided "as is" based on available data at time of analysis.
- - You are responsible for testing and validating changes in your own environment.
7. Limitation of Liability
- - To the maximum extent permitted by applicable law, MailFix is not liable for indirect, incidental, or consequential damages.
- - Aggregate liability is limited to fees paid by you in the 12 months preceding the claim.
- - Nothing excludes liability where exclusion is prohibited by law (including certain consumer rights jurisdictions).
8. Data Protection and International Use
- - Processing of personal data is governed by our Privacy Policy.
- - We design controls to support major frameworks (including GDPR/EEA and applicable US state privacy laws).
- - Cross-border data transfers, where applicable, use legally recognized safeguards.
9. Termination
- - You may terminate use at any time from account or billing controls.
- - We may terminate or suspend for legal risk, abuse, fraud, or material breach.
- - Clauses by nature surviving termination (liability, payment obligations, IP) continue to apply.
10. Governing Law and Disputes
These Terms are interpreted under applicable contract and consumer-protection laws. If you are a consumer, mandatory rights in your country/state of residence remain unaffected. Business disputes may be resolved in competent courts or by agreed arbitration where legally enforceable.
